Las partes o el Ministerio Público pueden pedir en cualquier estado del juicio que se declare una nulidad de las establecidas en la presente Ley.

De esta solicitud se dará traslado a las demás partes por tres días a cada una. Devueltos los traslados, se falla dentro de los dos días siguientes, si el asunto fuere únicamente de derecho. Si hubiere hechos que probar, se concederá un término de cinco días para practicar las pruebas que se soliciten. Vencido este término se decide el incidente.
