Corresponderá al Alcalde o Intendente, mediante resolución motivada, declarar iniciado el proceso de extinción del derecho de dominio de los inmuebles que no cumplan con su función social en favor del respectivo municipio o del Distrito Especial de Bogotá, o Intendencia de San Andrés y Providencia. Esta resolución será notificada personalmente a quien apareciere inscrito como propietario del inmueble y a los demás titulares de derecho reales inscritos siguiendo el procedimiento descrito en el artículo 88 de la presente ley.
