Art. 49. Cuando se proceda por infracción del inciso 2°, caso 1°, Artículo 2°, se observará lo dispuesto en los Artículos 42 y 43, y también lo prescrito en los Artículos 34 á 36. En el mismo auto en que se conceda término probatorio se señalará tino de los tres días siguientes al vencimiento de dicho término para el sorteo de los Jurados, que se verificará como se ha dispuesto, previa fijación de la hora. En el mismo auto se señalará también el día y la hora de la audiencia; dicho día no será anterior al tercero ni posterior al sexto, á partir de aquel en que se haya verificado el sorteo.
