El comandante que en caso de naufragio abandone el buque en condiciones de flotabilidad y no agotare los recursos para salvar la tripulación, armas, pertrechos, bagajes o caudales del Estado que estén bajo su responsabilidad, incurrirá en prisión de cuatro (4) a ocho (8) años.
