ARTICULO 97 . Dos calificaciones insatisfactorias sucesivas dentro del término de dos (2) años, respecto de los funcionarios y empleados, darán lugar a la insubsistencia, retiro o desvinculación del servicio, previa decisión motivada del funcionario competente, contra la cual proceden los recursos ordinarios por vía gubernativa. Entre las dos calificaciones deberá haber transcurrido por lo menos tres (3) meses.
