Si el actor debe de plazo vencido todo o parte del precio deberá consignar la suma debida y los intereses causados a órdenes del Juzgado, y acompañar el comprobante respectivo a la demanda. Esta consignación producirá los efectos de un pago, salvo que la sentencia de excepciones fuere adversa al demandante.
