ART 286. El delito de levantarse en armas contra la Constitución de la República ó contra el Gobierno legítimo, se castigará con la pena de muerte en los militares que lo hubieren promovido ó tramado sin comprometerse personalmente en el alzamiento, en el Jefe de la rebelión; y, de los que en ella tomaren parte, en el de mayor empleo, militar, ó en el más antiguo, habiendo varios de un mismo empleo.
