Presupuestos. La medida de aseguramiento procedente se decretará después que el presunto infractor haya sido vinculado como procesado, siempre y cuando que en el expediente exista prueba que permita inferir al funcionario, razonablemente, que el procesado es autor o cómplice del hecho punible investigado.
