ART. 1333. El Juez, a instancia de cualquiera de los interesados en la sucesión, señalará un plazo razonable, dentro del cual comparezca el albacea a ejercer su cargo, o a excusarse de servirlo, i podrá el Juez, en caso necesario, ampliar por una sola vez el plazo.

Si el albacea estuviere en mora de comparecer, caducará su nombramiento.
