°. Adiciónase el artículo 12 del Decreto 3940 de 2007 con el siguiente

Parágrafo

El Ministerio de Educación Nacional podrá, mediante acto administrativo, prorrogar hasta por la mitad, el término de dieciocho meses establecido en el presente artículo para que los municipios con más de 100.000 habitantes asuman la administración del servicio educativo, cuando se evidencie que no se han cumplido los requisitos señalados en este decreto."
