La pena es de veinte a treinta años de presidio, si a consecuencia de tales actos o servicios cae en poder del enemigo parte del territorio nacional, tropa, material de guerra, provisiones, o cualquiera otra especie de elementos indispensables a la defensa del Estado, o sufren derrota las armas colombianas.
