Los términos previstos por la ley, o en su defecto fijados por el juez, no son prorrogables. Sin embargo, de manera excepcional y con la debida justificación, cuando el Fiscal Penal Militar, el acusado o su defensor lo soliciten para lograr una mejor preparación del caso, el juez podrá acceder a la petición siempre que no exceda el doble del término prorrogado.
