Efectos del incumplimiento. La Autoridad Ambiental competente podrá, mediante resolución motivada, declarar el incumplimiento de lo dispuesto en el presente Decreto cuando quiera que el proyecto, obra o actividad no cumpla con lo preceptuado en el mismo y adoptar las medidas de policía previstas en el Título XII de la Ley 99 de 1993.
