La sentencia, si es en derecho, es apelable en el efecto suspensivo, y el recurso se sustancia por el superior, como el de apelación de un auto interlocutorio, y se resuelve de él, si es un Tribunal, en Sala de Decisión.

Las partes pueden pedir al superior que falle en conciencia.
