Los menores de diez y ocho años que violen las disposiciones de este Código serán juzgados por la Justicia Penal Militar.

Parágrafo

La Justicia Penal Militar no tendrá jurisdicción ni competencia para conocer de los delitos comunes cometidos o que cometan los miembros de los Resguardos de Aduanas y Rentas Departamentales, los Cuerpos de Circulación y Tránsito, los de Vigilancia o Guardianes de Cárceles y los Jefes de Policía a que se refiere el artículo VI del Decreto N9 1897 de 1953, y en general militar, siempre y cuando no se trate de miembros de las Fuerzas Armadas en servicio activo.
