Pasados tres (3) años para bienes muebles y cinco (5) años para inmuebles, contados a partir de la ejecutoria de la providencia que ordena la devolución de bienes o recursos, sin que hayan sido reclamados, el administrador deberá instaurar la acción civil para que se reconozca la prescripción adquisitiva de dominio especial a la que se refiere este artículo, o interponer dicha circunstancia como excepción en reclamaciones reivindicatorias de los terceros interesados.
