°. Negación de la concesión . En el evento de que las ofertas resulten contrarias a la ley, al plan de expansión portuaria, o que tengan un impacto ambiental adverso o puedan causar un daño ecológico, u ofrezcan inconveniente que no puedan ser remediados, así lo manifestará la gobernación del departamento Archipiélago de San Andrés, Providencia y Santa Catalina, en acto motivado en forma precisa que se notificará a quienes hubieren intervenido en la actuación y convocará para nuevas ofertas.
