Las averiguaciones se iniciarán de oficio, o a solicitud o por información de funcionario público, o por queja presentada por cualquier persona. Cuando la averiguación se inicie en virtud de queja, el funcionario encargado de adelantarla ordenará su ratificación bajo juramento, pero si por cualquier circunstancia no pudiere obtenerse, se adelantará sin ese requisito cuando así lo aconsejen la gravedad o la índole de los hechos denunciados.
