Oportunidad y trámite de la recusación. En cualquier estado del proceso, la s partes podrán recusar al funcionario que no se declare impedido. La recusación se propondrá por escrito ante el funcionario que conoce del asunto, acompañando las pruebas de la causal en que se funde. A más tardar al día siguiente el recusado ma nifestará en providencia motivada si estima o no fundada la recusación, ydispondrá pasar el duplicado o la copia de lo pertinente del proceso a quien corresponda, como si se tratare de impedimento.
