Todo establecimiento bancario deberá formar un fondo, que se conocerá con el nombre de fondo de reserva, el cual será creado o aumentado por medio de contribución de los accionistas o por el traspaso de utilidades indivisas.

Este fondo de reserva no podrá ser reducido a menos del veinte por ciento (20 por 100) del capital autorizado del establecimiento bancario, sino para atender a pérdidas en exceso de utilidades no repartidas.
