En el caso del artículo precedente, se suspende la ejecución de la sentencia o auto apelado, hasta que recaiga el fallo del superior.

También queda en suspenso mientras tanto la jurisdicción del inferior para seguir conociendo de los autos principales y de las incidencias que puedan ocurrir.

Se exceptúan de esta regla:

Los casos especiales establecidos en este Código.

Lo relativo a la seguridad o depósito de personas.
