Transferencia de signos distintivos sujetos a registro objeto de la garantía. En todos los casos en que se ejecute una garantía sobre signos distintivos sujetos a registro, en aplicación de lo dispuesto en el artículo 161 de la Decisión 486 de 2000 de la Comunidad Andina de Naciones, la Superintendencia de Industria y Comercio tendrá la facultad de negar la solicitud de transferencia de signos distintivos sujetos a registro objeto de la garantía, caso en el cual procederá a informar tal circunstancia tanto al acreedor garantizado como al adquirente del bien de propiedad industrial según corresponda, así como a la autoridad jurisdiccional competente o entidad autorizada ante la cual se haya llevado a cabo el trámite de ejecución según el caso.
