Declaración de contrabando. La declaración de que una mercancía es de contrabando se hará en la sentencia, en el auto de sobreseimiento definitivo, en el que ordena el archivo del expediente o en la providencia que dispone la cesación del procedimiento, según el caso, siempre que esté plenamente demostrada la materialidad de la infracción.
