Procedencia. Cuando se niegue el recurso de apelación, dentro de los dos días s i guientes el recurrente afectado podrá interponer, ante el mismo funcionario, el recurso de hecho. Para tal fin solicitará la expedición de copia de la resolución apelada con la certificación de la notificación del acto de interposición de la ape lación, del auto que la negó y de las demás diligencias que considere necesarias. El mismo recurso procede cuando, se niegue el de casación.
