La abstención de aplicar el auto inhibitorio en las circunstancias señaladas en el artículo 12 de la Ley 77 de 1989 y en el presente capítulo, será apelable ante la Sala Penal del correspondiente Tribunal Superior o ante el Tribunal de Orden Público, según el caso, de acuerdo con lo dispuesto en el Código de Procedimiento Penal.
