Para terminar la investigación, el funcionario instructor dicta un auto en que así lo declara, y entrega el expediente al juez sustanciador o a quien, haga sus veces. El auto del funcionario de instrucción debe contener lo mismo que los autos de los instructores que concluyen una investigación en los procesos menores, y la orden de poner a disposición del juez sustanciador a los sindicados que se hallen detenidos.
