En la pérdida o avería de buques a la entrada o salida del puerto, procederá el Jefe del Resguardo a tomar declaración al Capitán y dos individuos más de la tripulación del buque perdido o averiado, como también a tres Capitanes, prácticos, o personas que hayan presenciado la pérdida o avería.

Estas declaraciones tendrán por objeto fijar la causa de la pérdida o avería y la responsabilidad o culpabilidad del Capitán, conservando estas diligencias originales, para los efectos legales.
