Art. 60.º Los militares que habiendo estado en el goce de pensión la hubieren capitalizado en el Tesoro público, y que en virtud de haber prestado nuevos servicios en el Ejercito se presentaren á solicitar nueva pensión con motivo de tiempo ó antigüedad en el servicio, les será ella concedida si es que prueban lo que solicitan, pero deberá precisamente deducírseles la cuota capitalizada, señalándoles al efecto únicamente el saldo que á favor de ellos resultare, computándoles la totalidad de sus servicios.

Quienes no tienen derecho á recompensa ni a goce de pensión.
