Las Peticiones De Que Trata Este Decreto Deberán Ser Decididas Y Notificadas Dentro De Los Términos En Él Previstos

Decreto 1568 de 1998 · por el cual se dicta el régimen procedimental especial de las actuaciones administrativas que deben surtirse ante y por los organismos y autoridades que conforman el Sistema Nacional de Carrera Administrativa y de la Función Pública.

Las peticiones de que trata este decreto deberán ser decididas y notificadas dentro de los términos en él previstos. Si a su vencimiento no se hubiere notificado decisión que las resuelva, se entenderá que ésta es negativa.

Parágrafo

La ocurrencia del silencio administrativo negativo no exime de responsabilidad a los organismos, órganos y autoridades de que trata este decreto ni los excusa del deber de decidir, salvo que el interesado haya hecho uso de los recursos de la vía gubernativa con fundamento en aquel, contra el acto presunto.
