Cuando un fonograma publicado con fines comerciales, o una reproducción de ese fonograma, se utilicen directamente para la radiodifusión o para cualquier otra forma de comunicación al público, el utilizador abonará una remuneración equitativa y única, destinada a la vez a los artistas intérpretes o ejecutantes y al productor de fonograma, suma que será pagada por el utilizador al productor.
