Comparecencia de los testigos. Los testigos comparecen a declarar:

1. Previa citación por medio de boleta en papel común en que se indique la fecha, el lugar y la hora, en que deba rendirse la declaración. En este caso la boleta deberá ser firmada por el citado. En casos urgentes la citación podría hacerse verbalmente. En este caso y cuando el citado se nie gue a firmar, la citación se probará con el informe de la persona que la haya hecho.

2. El testigo podrá presentarse espontáneamente a declarar. Tal presentación se hará constar en el expediente.
