Una vez en firme la sentencia penal proferida en contra del alcalde, aun habiéndose decretado a su favor cualquier beneficio, el juez la comunicará al Presidente de la República en tratándose de Alcaldes Distritales, y a los Gobernadores en los demás casos, con el fin de ordenar la destitución y proceder conforme a lo dispuesto para la falta absoluta del Alcalde.
