Art. 16. Se presumen de contrabando los efectos que conduzca un buque que sea sorprendido en una rada o ensenada, ó en un puerto de la República donde no haya Aduana, salvo el caso de arribada forzosa ó encalladura debidamente comprobadas. Al buque, embarcaciones, Capitán, patrón y á los cómplices y auxiliadores se les impondrán las penas que establece el artículo 1° del presente Decreto.
