El servidor público que ilegalmente represente, litigue, gestione o asesore en asunto judicial, administrativo o policivo, incurrirá en multa y pérdida del empleo o cargo público.

Si el responsable fuere servidor de la rama judicial o del Ministerio Público la pena será de prisión de dieciséis (16) a cincuenta y cuatro (54) meses, e inhabilitación para el ejercicio de derechos y funciones públicas por cinco ochenta (80) meses.

NOTA: penas aumentadas por el artículo 14 de la ley 890 de 2004 (vigencia a partir del 1° de enero de 2005)
