Art. 3º. Los individuos que hubieren sido juzgados por delitos comunes, políticos ó militares cometidos durante la última guerra, tendrán derecho á que se les juzgué de nuevo, si ellos lo solicitan ó á pedimento de cualquier ciudadano en caso de que estos no lo hicieren, por la jurisdicción militar competente aunque hubieren sido condenados y aunque los respectivos juicios ó sumarios se hallen pendientes ante los jueces comunes.
