El Gobierno de la República declara neutrales para todo tiempo los puertos de uno i otro estremo del canal i las aguas de éste de uno i otro mar; i en consecuencia, en el caso de guerra entre otra naciones o entre alguna o algunas de éstas i Colombia, el tránsito por el canal no se interrumpirá por tal motivo; i los buques mercantes i los individuos de todas las naciones del mundo, podrán entrar en dichos puertos i transitar por el canal, sin ser molestados ni detenidos. Esceptúanse las tropas estranjeras, que no podrán pasar sin permiso del Congreso.
