En cualquier estado del proceso por el delito de contrabando o fraude a la renta nacional de aduanas, el Juez o funcionario instructor procederá a decretar el remate de mercancías retenidas previamente, si ellas constituyen bienes fungibles, o si comprobare que éstas, por su naturaleza o por las condiciones climatéricas o del almacenamiento o empaque, sufren o corren peligro de sufrir deterioro, deprecio, pérdida o merma.
