No se podrá reconocer personería jurídica a entidades de las cuales formen parte como fundadores personas que

Se encuentren inhabilitadas de conformidad con lo establecido en el artículo 186 del Decreto extraordinario 80 de 1980

Hayan ofrecido y ofrezcan sin la correspondiente autorización del Estado, programas en las modalidades educativas a que se refiere el precipitado Decreto.

Hayan participado en entidades u organizaciones que hubieren incurrido en la conducta descrita en el ordinal anterior.

Hayan participado como fundadores de una institución a la cual se le hubiere negado el reconocimiento de personería jurídica y no se hubiere vencido el término de que trata el artículo anterior.
