Los Oficiales y Suboficiales de las Fuerzas militares que no reúnan las condiciones sicofísicas determinadas por el reglamento militar sobre la materia, serán retirado del servicio. No obstante los dispuesto en este artículo, el Gobierno y los comandos de fuerza podrán mantener en servicio activo a aquellos oficiales y suboficiales que por sus calificaciones lo merezcan y cuando sus capacidades aun puedan ser aprovechables en determinadas actividades militares. Cuando se trate de oficiales, se requiera el concepto favorable de la junta asesora del ministerio de defensa.
