Funciones de Policía Judicial. Los Directores General, Regional y de establecimientos de reclusión del Instituto Nacional Penitenciario y Carcelario, tendrán funciones de Policía Judicial para la investigación de delitos que se cometan al interior de los establecimientos de reclusión, en los términos del Código de Procedimiento Penal hasta que la Fiscalía General de la Nación asuma el conocimiento.

LEGISLACIÓN ANTERIOR

Artículo 41.FUNCION DE POLICIA JUDICIAL DEL CUERPO DE CUSTODIA Y VIGILANCIA PENITENCIARIA NACIONAL. Los miembros del Cuerpo de Custodia y Vigilancia Penitenciaria Nacional podrán ejercer funciones de Policía Judicial en los casos de flagrancia delictiva exclusivamente, al interior de los centros de reclusión, o dentro del espacio penitenciario o carcelario respectivo como igualmente proceder a la captura de prófugos, de conformidad con lo establecido en el Código de Procedimiento Penal.
