Incurre en presidio de cinco a quince años:

1° El que en el mar o en los ríos de la República aprese a mano armada alguna embarcación, o comete depredaciones en ella, o ejerce violencia contra las personas que se hallen a bordo;

2° El que yendo a bordo de una embarcación se apodere de ella, ya sea para saquearla, destinarla a la piratería, o entregarla a un pirata;

3° El que por cuenta propia o ajena equipe un buque o embarcación destinado a la piratería, y

4° El que comercie o trafique con piratas o les suministre auxilio.
