El cargo de defensor es de forzosa aceptación. En consecuencia, tanto los nombrados por el procesado como los que designe el Juez o funcionario de instrucción, están obligados a aceptar y desempeñar el cargo, sin que puedan excusarse sino por enfermedad, por grave perjuicio del servicio, o por tener a su cargo dos o más defensas de oficio.
