El Poder Ejecutivo hará someter a Consejo de Guerra; a todo jefe o Comandante de fuerzas en operaciones que haya sufrido, una derrota; y si resultare que esta pérdida fue ocasionada por falta del valor o de pericia militar, será destituido, dejando a salvo las sanciones y penas especiales que sean aplicables, de conformidad con las disposiciones de la presente Ley.
