º. Se aplicará la Ley Penal Militar Colombiana, conforme a lo dispuesto en el artículo anterior, al nacional o extranjero que habiendo sido juzgado en el exterior, haya sido absuelto o condenado a sanción menor de la que se imponga en el país por el mismo delito. De la pena impuesta en Colombia, se descontará todo el tiempo de privación de la libertad que hubiere sufrido por razón del mismo delito.
