Siempre que se anule un proceso, se condena en las costas de la parte anulada al funcionario responsable.

Cuando la culpa no sea enteramente del Juez, como en el caso de ilegitimidad de personería de la parte a quien admitió como tal, sin poder admitirla, o en cualquiera otro en que ha debido advertir la irregularidad en que incurría, el pago de lascostas corresponde por mitad al funcionario y a la parte culpable.
