De conformidad con los artículos 356, 357 y 359 de la Constitución Política, las participaciones establecidas en la Constitución y en la ley en favor de las entidades territoriales con destino al sector salud, tienen una destinación específica. Las autoridades locales y los demás servidores públicos el nivel territorial que tengan a su cargo la distribución y utilización de dichos recursos responderán penal, fiscal y disciplinariamente cuando éstos se apliquen a fines distintos de los previstos en la Constitución y la ley.
