Para que un instrumento sea negociable debe llenar los siguientes requisitos:

1° Debe constar por escrito y estar firmado por el que lo extiende o lo gira;

2° Debe contener una promesa incondicional o una orden de pagar una suma determinada de dinero;

3° Debe ser pagadero a su presentación, o a un tiempo futuro fijo o determinable;

4° Debe ser pagadero a la orden o al portador, y

5° Cuando el instrumento está dirigido a un girado, debe expresarse en él nombre o indicación cierta de éste.
