º Archivo provisional . En el evento de que no se hubieren podido establecer los requisitos para la apertura de la investigación, se podrá ordenar el archivo provisional del expediente, sin perjuicio de que posteriormente se continúen las diligencias y se abra investigación, cuando aparezcan nuevos elementos de juicio, mientras la acción disciplinaria no se haya extinguido.
