Cuando el impedimento o recusación se refiera a un Magistrado, conocerá del asunto el Magistrado de la misma Sala que le siga en turno; si hubiere necesidad de completar la Sala, se sorteará conjuez. Cuando el impedido o recusado fuere un Juez, conocerá del proceso el juez del ramo Penal de la misma categoría que le siga en el orden numérico; si no hubiere más Jueces del mismo ramo y categoría, se dará cuenta al Tribunal respectivo para que llame y encargue del asunto al suplente del juez impedido.
