Si el concordato no es homologado, el juez declarará la quiebra de la sociedad en el mismo auto que niegue la homologación.

Si el concordato no se celebra, o si, celebrado y homologado, no es cumplido por la sociedad deudora, la Superintendencia lo declarará así y enviará todo lo actuado al juez competente para conocer de la quiebra, para que ésta se declare y se tramite como se dispone en el Título siguiente de este Libro.
